TERMS OF SERVICE
Haus of Brilliance | Luxcom Inc.
Last revised: October 20, 2026 | Effective when first published on this Site; not retroactive
1. Introduction; Who We Are
Welcome to Haus of Brilliance. This website, www.hausofbrilliance.com (the “Site”), is operated by Luxcom Inc., doing business as Haus of Brilliance (“Haus of Brilliance,” “Luxcom,” “we,” “our,” or “us”), a New York business with its principal customer-service address at 1212 Sixth Avenue, Suite 2304, New York, NY 10036, United States. Our online store is hosted by Shopify.
These Terms of Service (“Terms”) govern your use of the Site and, to the extent applicable, your purchase of products directly from us through the Site. Please read them before using the Site or placing an order. Additional terms displayed with a particular product, offer, financing arrangement, or purchasing program may apply. Where applicable law requires affirmative consent for a particular term or service, mere use of the Site does not substitute for that consent.
Nothing in these Terms excludes or restricts any consumer right or remedy that cannot lawfully be excluded or restricted. If you are shopping outside the United States, see Section 20 (International Customers).
2. Eligibility; Permitted Use
You must be at least the age of majority where you live to place an order, or act through a parent or legal guardian where permitted by law. You agree to provide accurate information and use the Site only for lawful purposes. We may refuse or cancel an order, restrict account access, or suspend Site access for reasonably suspected fraud, unlawful activity, misuse, security threats, or violations of these Terms, subject to applicable law and any required refund obligations. We do not discriminate in violation of applicable law.
You may not interfere with Site security; introduce malicious code; engage in unauthorized scraping, automated purchasing, or data harvesting; misuse promotional codes; impersonate others; or infringe another person's rights. We may take proportionate action to protect the Site, our customers, and our business.
3. Products; Fine-Jewelry Descriptions
We sell fine jewelry and related products that may incorporate natural or laboratory-grown diamonds, colored gemstones, cultured pearls, precious metals, plated metals, and other materials. The specifications and disclosures for the specific product and variant ordered are material to your purchase and are not replaced by a general disclaimer in these Terms. Please review the selected variant, metal, stone origin, treatments, measurements, size, finish, and included documentation before ordering.
We endeavor to present product information and images accurately. Appearance can vary somewhat because of lighting, photography, screen settings, reflections, and the individual characteristics of gemstones and pearls. Where a product description expressly identifies a weight, dimension, stone count, or grade as approximate or as a range, ordinary variations consistent with that representation may occur. Such qualifications do not authorize a materially different item, a false origin or treatment disclosure, or an incorrect precious-metal representation.
Photographs may depict a representative example or a visually equivalent design. Materials and specifications for the purchased SKU or variant control; for example, photographs of visually similar sterling-silver and gold designs do not change the metal composition stated for either item. Some photographs are enlarged to show detail and are not necessarily to scale.
Diamond grades, total carat weights, stone dimensions, and other attributes are as specifically represented for the item. “Total carat weight” refers to the aggregate weight of the stated stones, not necessarily the weight of any individual stone. Stone-origin and treatment disclosures are supplied in product information where applicable. If an item expressly includes a third-party grading report or certificate, we will supply the report or document represented; not every item includes one. An independent laboratory's assessments are subject to its own standards and methods, and do not replace our responsibility for our express product representations.
4. Appraisals; Valuation and Insurance
Some eligible items may include or qualify for an appraisal or insurance-related documentation provided through a third party. Eligibility and included documents will be specified or confirmed for the item. An insurance replacement appraisal is not necessarily the item's purchase price, fair-market value, liquidation value, resale value, or an offer to repurchase. We do not promise appreciation, investment returns, or any particular future resale value. Insurance applications, underwriting, coverage, claims, and payment decisions are determined by the insurer under its own terms. Nothing here excuses an inaccurate or misleading representation of an appraisal or product.
5. Prices; Offers; Availability
Prices and promotions shown on the Site may change prospectively without notice, subject to applicable law and accepted orders. Product availability and quantity limits may change. Promotional codes may be subject to clearly disclosed dates, item exclusions, eligibility conditions, and combination restrictions. We may reject attempted manipulation of offers, bulk purchases apparently intended for unauthorized resale, or transactions reasonably identified as fraudulent, subject to applicable law.
Any displayed comparison price, former price, percentage savings, suggested retail price, or other value claim is intended to be used only where supported by an appropriate factual basis and disclosed in accordance with applicable law. This section does not convert an unsupported comparison into a valid one or waive any remedy concerning misleading pricing.
Taxes, delivery charges, duties, and other amounts charged by us are displayed at checkout as applicable. Third-party international import charges are addressed in Section 9. We do not guarantee that every product or promotion will be offered in every jurisdiction.
6. Orders; Acceptance; Verification; Cancellation
Submitting an order is an offer to buy the selected merchandise on the displayed terms. An automated order-acknowledgment email confirms that we received the request; it does not by itself establish that we accepted every aspect of the order. Unless we expressly confirm acceptance earlier, our acceptance generally occurs when we confirm shipment of the merchandise, subject to mandatory rules in the customer's jurisdiction and any different terms expressly disclosed for an eligible preorder or special purchasing program.
We may verify payment, identity, address, availability, pricing, and suspected fraud before accepting or fulfilling an order. We may decline an order or cancel an unshipped order for legitimate reasons, including an obvious pricing or listing error, unavailable inventory, delivery restrictions, or failure of verification. We will notify you using the contact details supplied and promptly reverse or refund amounts charged for canceled merchandise as required by law. We will not substitute materially different goods without your agreement.
After submission, contact us promptly if you wish to change or cancel an order. Changes may not be possible once production, customization, sizing, fulfillment, or shipment has begun. This operational limitation does not supersede any applicable statutory cancellation right or mandatory shipment-delay remedy.
7. Payments; Fraud Prevention
You agree to provide accurate billing, shipping, and contact information and to use only a payment method you are authorized to use. Payments may be processed by Shopify or other authorized payment providers. Payment and financing options are subject to the terms separately presented by the relevant provider, including any required disclosures and agreements. We may perform reasonable fraud checks and request appropriate verification through secure channels; we will not request your full payment-card number by ordinary email.
You may dispute an unauthorized or erroneous charge through legally available procedures. Nothing in these Terms restricts your statutory chargeback, billing-error, or payment-dispute rights. We may provide truthful transaction, delivery, and return records to a payment provider when investigating a dispute.
8. U.S. Processing and Shipping
For in-stock U.S. orders, our published Shipping Policy generally describes processing within 1–2 business days, a 3:00 p.m. Eastern Time order cutoff, and complimentary two-business-day shipping where eligible. Available services, restrictions, rates, and the estimate shown at checkout apply to the particular order. Processing time is distinct from shipping transit time; selecting overnight service does not necessarily accelerate order preparation. Production, custom work, security verification, weekends, holidays, weather, and carrier conditions can affect timing.
We will comply with applicable shipment-delay notice, consent, cancellation, and refund obligations, including the FTC's Mail, Internet, or Telephone Order Merchandise Rule where applicable. An estimate does not excuse these obligations. For details about carriers, insurance, signature requirements, delivery exceptions, or pickup, consult the Shipping Policy.
9. International Orders; Duties and Taxes
International checkout is available only for destinations and products actually supported at the time of purchase. Shipping methods and delivery periods may vary by destination. Any import duties, VAT, customs taxes, or brokerage charges that we collect will be identified at checkout. Where such amounts are not prepaid or included, local authorities or carriers may collect them from the recipient, subject to applicable consumer law and the information presented before purchase. Customs inspections and import restrictions may affect delivery. Customers are responsible for complying with lawful destination-country import requirements applicable to them, but this does not transfer to customers any legal obligation that belongs to us as seller.
International consumer cancellation, delivery, warranty, jurisdiction, and other mandatory rights are preserved as described in Section 20.
10. Delivery Issues; Loss or Damage
We arrange tracking and shipping coverage as described in our Shipping Policy. If merchandise arrives damaged, tracking indicates delivery but the package cannot be located, or transit appears lost, please notify service@hausofbrilliance.com promptly so we can investigate. We may reasonably request photographs, packaging materials, a statement of the circumstances, or cooperation with the carrier or insurer where appropriate. A tracking scan is evidence relevant to an investigation but is not automatically conclusive against a customer.
Any allocation of risk of loss, duty to replace merchandise, or required refund will be determined under applicable law. We do not categorically shift responsibility for an undelivered consumer order to the customer simply because a carrier marked it delivered.
11. Returns; Exchanges; Final-Sale Items
Eligible U.S. merchandise may be returned or exchanged under our Refund & Return Policy, which currently describes a 30-day window measured from delivery of the applicable item, subject to product eligibility and required condition. Please contact service@hausofbrilliance.com for a return authorization before sending merchandise. Returned jewelry generally must be new, unworn, unaltered, and accompanied by its original packaging and included documents, consistent with that policy. We do not charge restocking fees for eligible returns. For ordinary change-of-mind returns, return shipping is normally the customer's responsibility unless we expressly offer otherwise or applicable law requires otherwise.
Where identified as final sale before purchase, custom-designed, individually personalized, engraved, customer-resized or otherwise altered, specially sourced, and made-to-order merchandise is not eligible for our voluntary change-of-mind return program, to the extent permitted by law. An ordinary stocked size or standard catalog variant is not automatically a personalized item merely because a customer selected it. Specific restrictions and any nonrefundable customization charges must be disclosed before purchase.
Final-sale status does not eliminate rights concerning defects, incorrect items, material misdescription, failure to deliver, or legally required cancellation or withdrawal rights. If another policy or product page uses less precise wording, this mandatory-rights qualification controls. See Section 20 for international statutory rights.
12. Product Errors; Defects; Material Discrepancies
Although we take care in maintaining a large catalog, a listing, photograph, specification, inventory count, or order may occasionally contain an error. We may correct inaccuracies and prospective listings; any action concerning an order already placed remains subject to the applicable contract and consumer law.
If you believe an item received differs materially from its stated description, has a defect, or was supplied in error, contact service@hausofbrilliance.com with the order number, a description, and available photographs. We may request reasonable inspection and the return of the item when necessary. We encourage prompt notice to support investigation, but no five-business-day notice deadline or condition-of-packaging requirement in these Terms extinguishes rights that cannot lawfully be limited.
Where a claim is verified, we may offer an appropriate repair, replacement, correction, partial refund agreed to by the customer, or full refund with return where suitable, subject always to remedies required by applicable law. We will provide return shipping at our expense when required by law or when our applicable policy expressly provides it. We do not require a customer to accept a partial refund in satisfaction of non-waivable rights. We may decline unsubstantiated or fraudulent claims after a reasonable review and may seek lawful remedies for fraud.
13. Limited 90-Day Manufacturing Warranty
Warranty designation and provider. Luxcom Inc., doing business as Haus of Brilliance, 1212 Sixth Avenue, Suite 2304, New York, NY 10036, offers the following Limited 90-Day Manufacturing Warranty to the original consumer purchaser of jewelry purchased directly from our Site. This is a limited, not a full, written warranty. Our Warranty FAQ contains customer guidance, but the specific terms in this section govern this voluntary warranty to the extent consistent with mandatory law.
Term and coverage. The voluntary warranty lasts 90 calendar days from the date the product is delivered to the original purchaser. It covers a defect in the product's original materials or workmanship that exists at delivery or is otherwise attributable to manufacturing and becomes apparent during that period. Depending on the underlying cause confirmed by reasonable inspection, this may include an original defect in a clasp, prong, setting, solder joint, or similar assembled component. It is not an insurance policy against loss or accidental damage.
What is excluded. This voluntary warranty does not cover ordinary wear and tear; scratches, dents, bending, stretching, or abrasion arising from wear; accidental impacts; misuse; loss or theft; contact with chemicals, cosmetics, or cleaners causing damage; plating wear or tarnish attributable to use or environmental exposure; improper maintenance; or damage caused by repair, alteration, resizing, or setting work performed by an outside party. An outside repair or alteration does not automatically eliminate coverage for an independent manufacturing defect that it did not cause. Natural variations in gemstones, pearls, and other materials consistent with the product's actual description are not defects. A lost stone may be covered if an original manufacturing defect in the setting is established, but a stone lost as a result of impact, misuse, or ordinary wear is not covered under this voluntary warranty.
Making a claim. During the 90-day period, contact service@hausofbrilliance.com with the order number, explanation, and clear photographs. We may request that the item be made available or returned for inspection, with reasonable instructions designed to protect the jewelry in transit. Do not send jewelry to us without receiving return instructions. We will evaluate the claim within a reasonable time, communicate the outcome, and not impose an unreasonable charge for examination of an eligible claim. If a covered defect is confirmed, we will bear reasonable necessary return and reshipment costs associated with providing the warranty remedy; if we request that the customer initially pay such costs, we will reimburse reasonable documented charges for a confirmed covered claim. Applicable law may require us to provide an appropriate label or cover costs earlier.
Warranty remedy. For a covered defect, we will, at our option and within a reasonable time, repair the item, replace it with a materially equivalent conforming item, or refund the purchase price, subject to mandatory law and availability. If a selected remedy cannot be completed within a reasonable time or without significant inconvenience where law requires that standard, we will provide the remedy required by law. This written warranty does not promise reimbursement for unrelated personal or consequential losses except where required by law.
Other rights. This voluntary limited warranty provides specific rights; you may also have other rights that vary by state or country. It does not exclude, replace, or shorten statutory consumer rights, including implied warranties that cannot lawfully be disclaimed, and it does not limit rights for products that were defective or materially misdescribed at delivery. In particular, we do not purport to disclaim all implied warranties on consumer goods covered by this written warranty. The 90-day period is not a limit on bringing claims under separate statutory warranties or longer mandatory international consumer guarantees. A final-sale designation governs our voluntary change-of-mind return program, not valid manufacturing-defect or statutory claims.
14. Gift Cards; Special Purchasing Programs
Gift cards, if offered, are subject to the terms disclosed with the product and applicable gift-card law. Our FAQ states that Haus of Brilliance gift cards do not expire and carry no inactivity or service fees. They are generally not refundable for cash except where required by law.
A genuine preorder, subscription, installment, or try-before-you-buy arrangement, if offered, is governed by the clear program-specific terms disclosed before enrollment, together with applicable law. No recurring payment, promotional text-message consent, or other separate financial obligation arises merely from browsing the Site or agreeing to these general Terms. Where program-specific terms conflict with these Terms, the more specific terms govern only to the extent legally permissible.
15. Account Security; Electronic Communications
You are responsible for maintaining the confidentiality of your account credentials and notifying us promptly of suspected unauthorized access. We may send transactional electronic communications concerning orders, delivery, security, customer support, and legal notices where permitted by law. Marketing email and text messages are subject to applicable law, our Privacy Policy, any applicable mobile-messaging terms, and separately obtained consent where required. Purchasing an item or agreeing to these Terms does not by itself constitute consent to marketing SMS messages. You may exercise applicable marketing opt-out rights using the provided methods.
16. Privacy; Shopify and Third-Party Services
Our online store is hosted by Shopify. When you visit or make a purchase through our Site, Shopify collects and processes personal information to provide shopping, checkout, payment, security, analytics, and related commerce services. Shopify Network Intelligence is enabled for our store. Through this feature, Shopify may use information about your interactions with our Site together with information from your interactions with Shopify and other merchants to provide enhanced services, including improved fraud protection, personalized shopping experiences, merchant insights, and more relevant advertising. Such information may be disclosed to or processed by Shopify and other service providers, including parties located in other countries. Shopify's processing for its own purposes is described in the Shopify Consumer Privacy Policy.
Our Site also uses advertising and analytics technologies, including Meta and Google pixels or tags and Microsoft Clarity and Triple Whale pixels. Subject to applicable legal requirements and privacy preferences, these services may process information about device and browser activity, interactions with pages or products, shopping carts, orders, and advertising conversions, and may use cookies or related identifiers. We describe the applicable purposes, categories of information, recipients, and available choices in our Privacy Policy. For advertising-related data-sharing choices, please visit Your Privacy Choices. To learn about and exercise applicable choices regarding Shopify's own processing, visit the Shopify Privacy Portal. Where required, additional cookie preferences are offered on our Site.
Payment, financing, insurance, appraisal, messaging, and other optional features may be provided by independent third parties under their own terms and privacy notices. We are not responsible for unrelated third-party content or conduct beyond our control, but this does not exclude any legal duty or responsibility that applies to Luxcom Inc. Nothing in these Terms is intended to waive mandatory privacy rights or substitute for consent when applicable law requires it.
17. Intellectual Property; Permitted Site Content Use
The Site, its original text, trademarks, branding, product photographs, graphics, arrangement, and other protectable content are owned or licensed by Luxcom Inc. or their respective owners and are protected by applicable intellectual property law. Except for personal, noncommercial shopping purposes or uses allowed by law, you may not reproduce, republish, commercially exploit, or systematically extract that content without authorization. No trademark or intellectual property license is granted except as expressly stated.
Nothing in these Terms prohibits lawful commentary, comparative references, honest reviews, fair use, or other legally protected activity.
18. Reviews and User Submissions
If you voluntarily submit a product review, photograph, comment, or other content to the Site, you retain your ownership rights. You grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and share that content in connection with operating the Site and presenting authentic customer reviews, for so long as permitted by law and our applicable policies. The license does not transfer ownership of your intellectual property to us. Separate permission may be requested for unrelated advertising uses of an identifiable person's likeness.
You are responsible for submitting content you have the right to share and for not knowingly making unlawful, fraudulent, infringing, or abusive submissions. We may moderate content for legitimate, viewpoint-neutral reasons, such as spam, privacy violations, threats, unrelated material, or unlawful content. We do not prohibit, penalize, or contractually restrict honest negative reviews or legally protected consumer communications.
19. Disclaimers; Limits of Liability; Indemnification
Website functionality. Subject to non-waivable legal rights, we provide the Site and its optional informational features on an “as available” basis. We do not promise uninterrupted Site operation or that every third-party feature will be free from technical errors. These website-function disclaimers do not override express product specifications, applicable written warranties, or statutory consumer rights.
Limitation of damages. To the maximum extent permitted by applicable law, neither Luxcom Inc. nor its officers, employees, or service providers will be responsible for remote, indirect, special, incidental, or consequential losses that were not reasonably foreseeable when the relevant contract was made. To the extent permitted by law, our aggregate liability for ordinary contract claims relating to a specific order will not exceed the amount paid to us for the merchandise giving rise to the claim. These limits do not apply to refunds or remedies that applicable law requires, and do not exclude or restrict liability for fraud, willful misconduct, personal injury or death caused by negligence where such liability cannot be excluded, non-waivable product liability, or other liabilities that cannot legally be limited. Some jurisdictions do not permit particular limitations.
Indemnification. To the extent permitted by law, a user who engages in unlawful conduct through the Site or materially violates these Terms agrees to reimburse us for reasonable third-party losses and costs directly caused by that conduct, after notice and an opportunity to participate in the defense. This does not require consumers to indemnify us for our own wrongdoing, prohibit good-faith complaints, or waive statutory rights. We may not control a defense or settle a claim in a manner imposing a personal obligation on the user without their consent, which may not be unreasonably withheld.
20. International Customers; Mandatory Rights
If you are a consumer located outside the United States, these Terms apply only to the extent consistent with mandatory laws applicable to your purchase. Nothing in these Terms deprives you of consumer protections, remedies, cooling-off rights, legal guarantees, or rights to bring proceedings in your home jurisdiction that cannot lawfully be waived by contract. A U.S. voluntary 30-day return window or 90-day limited commercial warranty does not reduce a longer or different right supplied by mandatory local law.
For consumers whose purchases are governed by applicable European Union distance-selling and consumer-conformity rules, qualifying purchases generally include a 14-day withdrawal right after delivery and at least a two-year legal guarantee for lack of conformity, subject to local implementing rules and recognized exceptions, including certain genuinely personalized goods. For consumers whose purchases are governed by applicable United Kingdom distance-selling laws, qualifying purchases generally include a 14-day cancellation period following delivery, subject to legal exceptions, and statutory remedies for goods that do not conform to the contract. A product described as “made to order” is not automatically exempt from statutory withdrawal rights solely because we prepare it after the order; the legal exception must actually apply.
Where a mandatory withdrawal right applies, the consumer may exercise it through methods required or allowed by applicable law, and we will provide required cancellation information, processing, and refunds. Additional mandatory digital cancellation mechanisms or disclosures may apply to particular markets; this text alone is not intended as a substitute for those measures. Mandatory rules in Canada and other destinations likewise take precedence to the extent applicable. Country-specific notices displayed at checkout or in our policies supplement these Terms without diminishing those rights.
21. Dispute Resolution for Eligible U.S. Transactions; Individual Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS AN INDIVIDUAL ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER THAT MAY AFFECT YOUR RIGHTS IF IT IS VALIDLY MADE PART OF YOUR CONTRACT. It is intended for disputes relating to purchases by consumers in the United States and applies only if an enforceable agreement to these Terms has been formed. It does not bind customers to whom mandatory law makes it inapplicable, and does not apply retroactively to a transaction made before this version became effective merely because we subsequently published it.
Informal resolution first. Before starting arbitration or a court action (other than an action for urgent provisional relief or a proceeding with a shorter non-waivable deadline), the claimant should email a written notice to legal@hausofbrilliance.com identifying the order or transaction, the dispute, the requested remedy, and reasonable contact information. We will respond in good faith and both sides will attempt to resolve the dispute informally for 30 days after receipt. Any applicable limitations period is tolled during that 30-day period to the extent legally permissible. A required informal process does not prevent a consumer from exercising statutory rights where delay or preconditions would be unlawful.
Agreement to arbitrate. If not resolved informally, you and Luxcom Inc. agree, to the extent permitted by law, to resolve covered disputes individually through binding arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules and Consumer Due Process Protocol, including applicable supplementary mass-arbitration rules when their criteria are met. The Federal Arbitration Act governs interpretation and enforcement of this arbitration provision where applicable. The arbitrator may award any individual relief available under applicable law, including legally available statutory remedies, and must respect applicable limitations on remedies only where enforceable. The arbitration may proceed remotely or at a reasonably convenient location consistent with the administrator's rules and applicable law. Fees and costs will be allocated under the AAA's applicable consumer rules and controlling law; we will pay amounts required to be paid by the business. No term here requires a consumer to pay fees that would make arbitration impermissibly inaccessible.
Exceptions. Either party may bring an eligible individual dispute in small-claims court. Either party may seek temporary judicial relief where necessary to preserve rights pending arbitration. Nothing in this section waives a public-injunctive-relief remedy or another remedy or forum right where such waiver is prohibited by law. Disputes that cannot lawfully be arbitrated may proceed in the proper court.
Individual proceedings; class waiver. To the maximum extent permitted by law, covered disputes will be resolved only on an individual basis, not as a class, collective, consolidated, or representative action. No arbitrator may adjudicate another person's claim or award non-individual relief except as required by applicable law. If a court determines that this class or representative waiver cannot be enforced for a particular claim or remedy, that portion must proceed in court to the extent required by law, and the remaining arbitrable claims may proceed separately in arbitration, unless applicable law requires otherwise. This provision does not prohibit coordination of administrative procedures permitted under applicable AAA mass-arbitration rules while individual claims remain individual.
Opt out. You may opt out of this arbitration agreement by emailing legal@hausofbrilliance.com with the subject line “Arbitration Opt-Out” within 30 days after your first purchase on or after the effective date of these Terms. Include your name, purchase email address, and order number. Opting out of arbitration will not affect your purchase, service, pricing, or other rights, and both parties will retain any right to pursue claims in an appropriate court. We will not treat an opt-out as consent to marketing.
Formation and severability. Whether the parties validly agreed to arbitration will be determined under applicable law, and a court may decide questions of contract formation or enforceability to the extent required by law. This arbitration provision is severable from the rest of the Terms except as specifically provided above concerning the class/representative waiver.
22. Governing Law; Courts for Non-Arbitrable Disputes
To the extent legally permitted, the laws of the State of New York, without applying conflicts-of-law principles that would require another state's law, govern these Terms and ordinary disputes arising from them. The Federal Arbitration Act governs covered arbitration matters where applicable. For disputes properly brought in court and where legally permissible, the state and federal courts located in New York County, New York, will have jurisdiction and venue. This choice does not displace a consumer's mandatory rights to local substantive law, protections, or courts, including applicable international consumer jurisdiction rules or any non-waivable U.S. state rule.
23. Changes; Severability; Entire Agreement; Contact
We may update these Terms prospectively by publishing a revised version with its effective date. Changes will not retroactively eliminate accrued rights or automatically impose a newly added arbitration agreement on a previously completed transaction. Where required by law, we will provide notice and obtain additional consent. If a provision is unlawful or unenforceable, it will be limited or severed only to the extent permitted, and the remaining valid provisions will continue in effect. The failure to enforce a term once is not a general waiver.
These Terms, together with the product-specific details presented at purchase and the applicable policies expressly incorporated or linked here, form the relevant agreement to the extent validly accepted. They do not override mandatory law or separate affirmative agreements for financing, insurance, subscription, SMS marketing, or other regulated services. A more specific product or promotion term governs the relevant offer only where it is valid and lawfully disclosed.
